Hunter Biden faces two counts of making false statements for allegedly providing inaccurate information on forms when he bought a Colt revolver in Delaware. A third charge accuses him of unlawful possession of the firearm, which carries a potential sentence of up to 10 years in prison.

These charges were filed by Justice Department Special Counsel David Weiss, who has been conducting an investigation into Hunter Biden's activities since 2018.

This indictment follows a failed plea deal reached between Biden and Weiss two months ago, which covered not only the firearm charge but also alleged tax violations. The plea deal fell apart due to disagreements over the possibility of additional, unspecified charges against the president's son.

In the July agreement, Hunter Biden agreed to plead guilty to minor tax charges and was offered probation, as he had already settled his tax obligations along with associated penalties. Additionally, Weiss had agreed to suspend the felony gun charge if Biden completed "pretrial diversion," often involving counseling or rehabilitation.

However, the deal unraveled during a July 26 hearing over whether Hunter Biden could potentially face additional charges related to his business dealings in Ukraine, China, and other countries. The judge raised the possibility of unregistered lobbying for foreign governments, a potential violation of the law.

Three weeks later, after the plea deal collapsed, Weiss dropped the tax charges and indicated the forthcoming gun charge indictment by the end of September.

These legal troubles have cast a shadow over the political landscape, impacting President Biden's re-election campaign. Republicans, without presenting evidence, have accused the Justice Department of favoritism toward Hunter Biden and criticized Weiss, a Republican appointee, for being lenient in the investigation.
